Lawsuit update

By the end of this week The Trade Banc, in Federal Court, intends to seek declaratory judgment to cancel Tradebank International’s alleged mark. Courts have many times held that generic terms such as trade and bank are not enforceable as trade marks holding that generic terms cannot be trademarked.

The Trade Banc was recently sued by Tradebank International in federal court in Georgia for alleged trademark infringement.  The lawsuit is without merit, and we are eager to defend ourselves. 

As an initial response, the law provides for a motion to dismiss procedure, which we filed yesterday to challenge the very plausibility of the lawsuit.  As spelled out further in our papers, Tradebank International’s alleged mark is not entitled to trademark protection.  Numerous courts around the country have held, as a matter of plain law, that marks with generic names like “trade” and “bank” are not entitled to any trademark protection.  (See Community First Bank v. Community Banks, 360 F. Supp. 2d 716, 725 (D. Md. 2005) (holding that a party’s marks with the words “community” and “bank” “are generic and not protectable, as a matter of law”).
   
If Tradebank intends to proceed further with this matter, we intend to file countersuit in a more appropriate federal court in Utah seeking declaratory judgment to cancel Tradebank International’s alleged mark.  

Tradebank must be made to understand that we intend to defend ourselves vigorously from this unfounded action.  We have already obtained statements from a number of third parties indicating this is developing pattern of conduct on their part — threatening unfounded litigation as a way of intimidating competitors in the barter industry.  They should be forced to compete with others in a fair and legal manner.

Software support firm refuses to honor their contract.

In October of 2009 we contracted with a firm in Shanghai to work on enhancements and upgrades to our software. After 4 months  of training their tech person assigned to our company they then came back and said we must double the agreed upon contracted hours or they would not honor the contract. Even if we were so inclined we will never do business with any firm or person with such a lack of integrity to not honor a written contract. I am sure there are many fine software people in China but if you are considering using a firm there you may want to find out who this unethical, unreliable firm is so you do not get caught in such a trap. Just reply to this blog and include an E-mail address where we can reply to you and we will tell you this companies name.

First 2 months sales in the network up 67%

In the first 2 months of 2010 the total barter sales in The Trade Banc network were up 67.3% from the previous year. These sales are for exchanges that were open for 1 year or more and do not include sales of new exchanges opened less than 1 year, showing again the strength of the barter industry in these terrible economic times. A good part too of the sales increase is due to the strength of the many exchanges within The Trade Banc network that allow trading between members of one exchange with members of another exchange, greatly increasing goods and services available to all.

Member Protection Plan

Since it’s introduction a few months ago The Trade Banc Member Protection Plan has been well received. Under the plan any exchange that signs up for the plan, and all new exchanges that are automatically added can assure their members that should their exchange ever go out of business that the members barter dollars are safe and the member will be assigned to another exchange so business continues as usual. The member protection plan has no effect on an exchange should they sell their exchange or merge with another exchange and there is no cost to thte exchange for the Member Protection Plan.

Counting correctly

In The Trade Banc if you are an attorney in an exchange and listed as attorney, legal services, lawyer, divorce attorney, divorce lawyer you are counted as one member.. An attorney in Do Barter under the same listings is counted as 5 members (one for each listing). Certainly not truthful huh?

2009 growth

December 24th, 2009

The Trade Banc saw tremendous growth in 2009  with 56 exchanges added to the list of software users utilizing The Trade Banc Barter software.  Besides big growth in The US we added exchanges in The Philippines, South Africa, Brazil and soon offices in several other countries. We also added Ben Shen to our software development staff as we prepare for future growth and expect our European office to open in the first quarter of  2010 in France.
